Louisiana Affiliate Nexus Tax introduced

Legislators in Louisiana are considering a click-through nexus law. Commonly known as “Amazon” laws after their most visible target, these laws deem an out-of-state company to be an in-state company for sales tax collection purposes if the company receives commissioned referrals from in-state resident “affiliates.” The out-of-state company must then collect sales tax for the state. While 21 states have considered “Amazon” laws in the past three years, only five have enacted them: Connecticut, Illinois, New York, North Carolina, and Rhode Island. Connecticut Inches Closer to an Ad Tax

Yesterday Connecticut took one step closer to having an Internet Tax as Bill SB 5481 passed its first legislative hurdle. Bills like SB 5481 require Advertisers to charge customers a sales tax if they have affiliates in a certain state, in this case Connecticut. Affiliate marketers in Connecticut are working hard to reverse the course of this bill. Virginia Affiliates: PMA Affiliate Tax Alert!

The PMA has received word that an advertising tax will be proposed in Virginia. If this tax passes, they predict over 100 advertisers will terminate their affiliate programs with Virginia publishers. The PMA’s effectiveness in fighting legislation that directly harms the income of affiliates will ultimately be bolstered by readiness.
