Louisiana Affiliate Nexus Tax introduced

Legislators in Louisiana are considering a click-through nexus law. Commonly known as “Amazon” laws after their most visible target, these laws deem an out-of-state company to be an in-state company for sales tax collection purposes if the company receives commissioned referrals from in-state resident “affiliates.” The out-of-state company must then collect sales tax for the state. While 21 states have considered “Amazon” laws in the past three years, only five have enacted them: Connecticut, Illinois, New York, North Carolina, and Rhode Island. Virginia Affiliates: PMA Affiliate Tax Alert!

The PMA has received word that an advertising tax will be proposed in Virginia. If this tax passes, they predict over 100 advertisers will terminate their affiliate programs with Virginia publishers. The PMA’s effectiveness in fighting legislation that directly harms the income of affiliates will ultimately be bolstered by readiness. PMA files brief in New York State Supreme Court against “Affiliate Tax”

The Performance Marketing Alliance (PMA) filed a brief yesterday in New York State Supreme Court in support of Amazon.com and Overstock.com in a pending lawsuit with the state. The case is over whether affiliate partners constitute a physical “nexus” in the state, and hence require online only retailers to charge consumers sales tax on online purchases.
